MyFamGPS Terms of Use

1. Acceptance of Terms

By downloading, installing, or using MyFamGPS ("the app", "the service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the app.

MyFamGPS is an application by LocalizaTech SpA (Tax ID: 76.295.941-0), Los Militares 5620, Office 303, Las Condes, Santiago, Chile.

2. Service Description

MyFamGPS is a mobile application that allows family groups to share their real-time location voluntarily and in a controlled manner. The service includes:

• Real-time GPS location sharing among group members.
• Creation and management of family groups.
• Push notifications about group events.

3. Eligibility

You must be at least 13 years old to use the app. If you are under 18, you must have the consent of a parent or legal guardian. By registering, you declare that the information provided is truthful.

4. Acceptable Use

Permitted:

• Using the app to share your location with family members or trusted individuals with their explicit consent.
• Creating groups with people who have voluntarily agreed to participate.

Prohibited:

• Using the app to track individuals without their knowledge or consent.
• Sharing account credentials with third parties.
• Attempting to access other users' accounts or groups without authorization.
• Using the app for surveillance, harassment, or any illegal activity.
• Reverse engineering, decompiling, or modifying the app.
• Using scripts, bots, or automated tools to interact with the service.

5. User Accounts

You are responsible for maintaining the confidentiality of your account. You must notify us immediately if you suspect unauthorized access. We reserve the right to suspend or delete accounts that violate these terms.

6. User-Generated Content

You are responsible for any information shared through MyFamGPS, including your username visible to group members. You must not share false, defamatory, offensive, or illegal information through the app.

7. Privacy and Location Data

The processing of your personal data is governed by our Privacy Policy. By using the app, you accept that policy.

Important: You are responsible for obtaining the consent of the people you invite to your group before their location becomes visible to other members.

8. Service Availability

The service is provided "as is" and "as available." We do not guarantee uninterrupted availability; interruptions may occur due to maintenance, updates, or causes beyond our control. We reserve the right to modify, suspend, or discontinue the service with prior notice.

9. Intellectual Property

The app, its design, code, logo, and content are the property of LocalizaTech SpA and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal and non-commercial purposes.

10. Limitation of Liability

To the fullest extent permitted by applicable law, MyFamGPS shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the service. We are not responsible for decisions made based on inaccurate, outdated, or unavailable location data. Location accuracy depends on the device, GPS signal, and user connectivity.

11. Changes to the Terms

We may update these terms occasionally. Significant changes will be notified through the app, and renewed acceptance will be requested. Continued use of the service after notification implies acceptance of the updated terms.

12. Governing Law

These terms are governed and interpreted in accordance with the laws of Chile. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the competent courts of Chile.
